    Kauai Police to be armed with TASERs - Who's First to Get Tazed?

    The Kaua‘i County Attorney’s office has approved this week a contract for the Kauai Police Department to purchase TASERs outfitted with cameras.

    The KPD is the last of four Hawaiian police departments to get TASERs, stun guns that immobilize their targets with electrical currents instead of bullets.

    Police Chief Darryl Perry said in an e-mail that Monday, after significant legal negotiations with the company TASER International, the County Attorney’s Office alerted the KPD that it would approve the contract.

    The department will get 20 TASERs with camera attachments, he said.

    TASERs were already approved by the County Council for KPD’s current fiscal year budget, for which approximately $30,000 was allocated.

    Perry said a TASER is an electronic control device that serves as a “highly effective, less-than-lethal control tool for law enforcement agencies.”

    According to the manufacturer, several police departments have reported a decrease in suspect and law enforcement injuries as a result of using the stun guns.

    Such claims, the company states, are supported by police statistics from departments across the nation, such as Phoenix, Ariz., which reported a 67 percent decrease in suspect injuries in 2004 and a 54 percent reduction in use of deadly force.

    TASER is based out of Scottsdale, Ariz.

    Kauai police will likely receive the first order of TASERS before the end of this fiscal year, or June 30.

    Folks, here is my 2 cents:   Chances are that a few police officers will not be able to resist tazing some Kauai residents. I will make a forcast prediction that Officer Steven Vinzant, aka “FLATTOP” will be the first to tazer somebody. Recall Vinzant was the only retarded cop that was spraying mace on people during the Super Ferry protests.  The first to taze will either be Officer Steven Flattop Vinzant, Sgt. Richard Rosa, or Vice Officer Rose.

    Police filming incident may face appeal

    A man accused of videotaping police officers conducting training in November 2006 was granted release on $400 bail, yesterday, in Fifth Circuit Court, pending his appeal.

    Darrel Lloyd Jarmusch was charged with resisting arrest, obstructing government operations and harassment stemming from a Nov. 28, 2006, incident for which he is accused of filming several police conducting training exercises near the Lihu‘e Costco.

    According to a police report, Jarmusch showed up, camera in hand, at a training and accused one of the officers of stopping cars randomly.

    Police yesterday said they weren’t conducting any random traffic stops at the time, noting to do so they would have had to inform the public ahead of time, along with other protocols.

    Police also said the reason they were able to pull a car over as part of the exercise was that the car’s plates had shown multiple traffic violations after the plates identifying marks were entered into a data base.

    After Jarmusch was reportedly told to stop filming several times, officers arrested him and confiscated his film, according to police reports.

    Arguing the incident had occurred while Jarmusch was on probation for another offense, Tracy Jean Murakami, prosecutor, filed a motion asking a judgment be entered from a 2001 case in which Jarmusch faced several weapons-related charges.

    In the motion, Murakami asked for relief from an “illegal sentence” in the 2001 case, stating, “a conviction needs a sentence.”

    Murakami asked Fifth Circuit Judge Kathleen Watanabe to enter a judgment on the previous case. An electronic records search indicated Jarmusch had been sentenced Feb. 20 to a deferred five years for count one, with an additional year for count four in the case. Watanabe said Jarmusch also had served 800 hours of community service, completed anger management, paid crime victim compensation fees and been given a convicted felon status.

    Jarmusch’s attorney, John Cardona Calma, filed a memo in opposition to the prosecutor’s motion, supporting the Feb. 20 ruling.

    Before granting the prosecutor’s motion, Watanabe said she was “at a loss” at all the time and effort going into the case by the prosecutor’s office and the county’s Victim Witness Program.

    “Because of the continued energy that gets poured into this case ... I will go ahead. Maybe this is a gray area. In order to bring closure to this case I will make it clear, I am re-sentencing (Jarmusch).”

    The re-sentencing did not impose additional jail time.

    During the hearing on the motion to release Jarmusch on bail pending his appeal, which prosecutors had asked to be set at $1,000, Jarmusch said he had no plans to flee and that he hoped to return home to Kilauea with his wife to help save his farm.

    He also apologized.

    “I made a stupid, prideful mistake when I filmed the police officers and what they were doing,” he said.

    Watanabe said, “I’m glad to hear that.”

    Having some fun with the herd...

    The ACN Advantage Saves You Money
    My second wireless customer is now saving over 150.00 per month on his wireless plan.  He went from Nextel paying over 300.00 per month for unlimited calling.  He is now on verizon and pays 99.00 per month with unlimited calling.

    Did my rantings get recorded? Yes, and it was a good show.
    Hey FLATOP (Steven Vinzant, the cop everyone on Kauai loves to HATE) - You cut me off using your patrol car at the intersection  and stare me down right at Koloa Rd and Maluhia Rd while I was on my moped.  Ask the 2 Koloa Town workers, they saw it.

    You drive around in your squad car, terrorizing people and recording people (much like me recording your cop buddies) and your attitude alienates you from what good cops are left in the Kauai Police Department, you make the entire departent look  bad and to top it off, you have engaged in "theft of services" by accessing someones wireless router to gain access to the internet.  You do this while you are parked in Koloa supossedly working. 

    Are you using the GPS attennae you stole from me the night you assautled me?

    As a cryptologist in the NAVY, you learned some pretty cool skills.  But I am a PINKERTON and PINKS always win over FLATOPS.  

    I think people like you on my website better than me being on your website even with my ranting and raving.  

    You are the terrorist.  The license plate holder on your police cruiser reads: "MY ROAD< MY RULES"  Is this why people fight you in court, because you are a pathetic excuse for a Kauai Police officer?  You make the whole KPD look terrible.

    It is pretty futile to rant at the back of a moving police cruiser drven by FLATOP but it sure was  releasing some pent up anger for the injuries him and his cop bussies inflicted on me and my family.

    Have You Seen Koloa Lateley?

    Sadly, Old Koloa is turning into the New Koloa Town.  Thanks to our County Attorney and INFAMOUS Planning Department, Koloa, Poipu and surrounding areas are growing fast than other parts of Kauai.  It seems like yesterday when community members were crying for a moratorium.  Kauai is then next Maui.

    Early Retirement Around The Corner



     As a Federal and Corporate Computer and Network Analyst, I am contacted by entities and people seeking technology solutions to resolve problems with computers, networks, and communication infrastructure.

    Living in Hawaii out in the middle of the Pacific Ocean has its own set of special challenges as I am the I.T. Director for C.A.R.C.L.E., who is located on the Mainland. 

    The only problem I see with being a "sought after technician" is that I am not in two places at the same time.

    3 Kauai Police Suspended WITH PAY
     AND GET THIS:  They all earned over 50k in pay despite not actively working.  The County of kauai should require all three of them to pay back the funds that were payed to them while on suspension.  Welcome to Kauai Police Corruption!

    Three Kauai police officers entered “no contest” pleas yesterday to second-degree theft and tampering with government records charges for failing to attend a federal- and county-funded training.

    The training the police were supposed to attend was a marijuana eradication seminar from Sept. 13 through Sept. 15, 2005, in Maui.

    Instead, the state argued, Sgt. Wesley Perreira, Sgt. Lawrence Stem and officer Channing Tada flew to Kahului, clocked hours, were cut per-diem checks and used their time as a vacation.

    Perreira, Tada and Stem were indicted on counts of tampering with a government record, a misdemeanor; Tada and Stem also were charged with two, second-degree felony theft counts. Stem was Tada’s superior at the time.

    Perreira was charged with one count of felony theft and one count of second-degree attempted theft.

    All three face up to 23 years in jail and $26,000 in fines, according to Deputy Attorney General Christopher Young.

    Though the three haven’t been fired, a letter of pending dismissal was sent out to them Jan. 15, according to Chief of Police Darryl Perry.

    The letter states the men are entitled to a pre-determination hearing, in which they can present their case against pending dismissal, with their representatives.

    The letter also states the hearing was to be Jan. 30; however, that date was pushed back to February because of the pending court adjudication hearings, Perry said.

    The three have been on administrative leave with pay since Aug. 22, 2006.

    That status will stay in place pending receipt of court documents confirming their “no contest” pleas; following that, the department could put the men on administrative leave without pay, pending dismissal.

    Though Perreira, Stem and Tada didn’t contest the charges, the state didn’t offer them a plea deal for forgoing trial.

    Michael Green, Perreira’s attorney, said the state had offered to dismiss some of the charges in exchange for guilty pleas; but that was not an option, he added.

    “We have not plead guilty to any of the charges,” Green said. “They’ve elected not to contest the charges.”

    Young, who had asked Fifth Circuit Judge Kathleen Watanabe to consider rejecting the no- contest pleas, said in an interview outside of court that the officers should have admitted guilt because “they took an oath to uphold the law.”

    Though Perry couldn’t comment on the severity of punishment the men face, noting, “that is to be decided by the judge,” he did say police have a high standard to which they are held.

    He also said that standard reaches all KPD employees.

    “Whether you’re a subordinate or supervisor ... we emphasize the need to ‘do the right thing,’” he said.

    “...We expect them to do what they have been trained to do, regardless of the position they hold. In addition, we have departmental directives to assist in their decision-making process. ...Employees are not required to obey any order which is contrary to federal or state law, local ordinance or standard of conduct.”

    The Twisted Badge Publishes Pinkerton VS. KPD Cases

    CORRUPTION IN HAWAII PART 4

     On the island of Hawaii visitors are invited to taste macadamia nuts, search for pearls and visit an active volcano, but the one thing they won't see is a police car. On the "Big Island", officers drive their personal vehicles and the police department reimburses them about $450. per month plus fuel expenses. A small, removable blue light is the only indication the officer is on duty. Things are quite a bit different on the island of Kauai, where marked police units patrol on a regular basis and officers seem unrestrained in the use of force. Krs Pinkerton, who has lived on the "Garden Isle" for 20 years and raised his family there, has been arrested 4 times in 11 months, beaten while in jail and indicted by the grand jury. All charges were dismissed "With Prejudice" and Pinkerton, known as "Pink" to his friends, has hired a California attorney to file a federal lawsuit against the officers involved. I recently spent a day with "Pink" , a computer and network analyst, who told me it all started after he met with the former chief of police K.C. Lum and offered to place GPS units in the Kauai PD patrol units.

     Krs Pinkerton is a problem solver. When corporate clients suffer a computer crash or loss of data, he gets the call. If it's on Kauai, he heads to their location, but if it's on another island, he heads to the airport.  Traveling allows time to reflect and on one trip he started thinking about how valuable it would be for a police department to know where patrol units are at all times. When he met with Kauai Police Chief K. C. Lum and offered to install GPS units at no charge, the Chief liked the idea, but nothing ever came of it. Why wouldn't patrol officers want dispatch to know where they were at all times? Could it be that a few officers feared Pinkerton's idea might expose corruption?

    TIMELINE 

    Pinkerton's problems began shortly after his offer of help went nowhere. Were the police using their badges to silence him and eliminate him as a threat to business as usual? Here's the timeline of escalating charges:

     October 24 2005 - Pinkerton was arrested outside his residence for "Impersonating a public servant" and two counts of harassment. Alleged victims: tourists from Sacramento who wanted him to move his truck so they could make a u-turn. After they left, a police officer sitting in a patrol car parked nearby took a report from the tourists and Pinkerton was arrested by officers David Banquel and Gilbert V. Asuncion. Bail was set at $250. The case was later dismissed.

     November 29, 2005 - Pinkerton filed complaints against officers Banquel and Asuncion for filing a false police report.

    December 14, 2005 - Pinkerton was arrested at his home in Koloa at 02:30 am for an incident that occurred the day before at a school function when Officer Asuncion swore at and stuck his finger against Pinkerton's chest.

    Pinkerton was charged with Terroristic Threatening in the 1st degree and Intimidating a witness. The officers made this felony arrest without an indictment and without an arrest warrant. During the arrest, officers' threats to shoot Pinkerton's dogs were tape recorded. The alleged victim was officer Gilbert Asuncion. The arresting officers were Clayton Okamoto, Nelson Gabriel and Gilbert Asuncion. The investigating officers were Damien McCallum & Sgt. Richard Rosa. Bail was set at $10,000. (According to the US Constitution, school functions fall under "federally protected activities".)

    December 29, 2005 - Pinkerton filed complaints against Officers Clayton Okamoto, Nelson Gabriel, Gilbert Asuncion and Sgt. Richard Rosa for false arrest. The case was dismissed on 8/1/2007.

    March 5, 2006 - Pinkerton was arrested at 11:30 p.m. by two Kauai police officers against whom he had filed complaints. He was parked on the side of the road and asleep, yet he was charged with driving under the influence. No breath or blood tests were taken and no FST (field sobriety test) was conducted. He was additionally charged with having an open container, resisting arrest, criminal property damage and two counts of assault in the 1st degree against two Kauai Police Officers. The alleged weapon used was the boots he was wearing. Bail was set at $10,125. The arresting officers were Steven Vinzant and Phillip Banquel (brother to David Banquel).

    "I was beaten when they pulled me out of my truck." Pinkerton recalled." Then they took me to the hospital to get clearance to go to jail. I remember being hit and kicked and punched a couple of times on the way from the hospital to the to jail." Pinkerton then described what happened next. "When I got to the jail I was thrown into a holding tank and my head slammed in the jail cell door. To this day I have this groove on the left side of my head."

    Before he was released on $1000. bail. Pinkerton asked for medical attention. "I couldn't walk." he said. "I was picked up by an ambulance at the jail exit. I had a fractured wrist, concussion and ringing in my ears. At the ER they bandaged the wrong wrist and sent me home." he said. "Later I went to Queens Hospital on Oahu where they did an MRI and diagnosed a right wrist fracture and a head injury resulting in a concussion.

    April 4, 2006 - Pinkerton filed complaints against Officers Phillip Banquel, Steven Vinzant and Nelson Agni for false arrest, police abuse and excessive force. The case was dismissed on 8/23/2006. 

    August 24, 2006 - The day after the case was dismissed, Pinkerton was indicted and re-arrested on the same charges.

     THE POLICE REPORT

     When the two Kauai police officers who arrested Pinkerton filed their report with the local prosecutor, they sought charges against him for drunk driving, assault with a deadly weapon (his boots) and resisting arrest. "I thought I was going to be sent to prison for 30 years." said Pinkerton, recalling his first appearance in court. "I was shocked that it had escalated so much and I was pretty numb."

     THE PROSECUTION

     Facing separation from his family by incarceration, Krs Pinkerton decided to take a stand.  He began to document everything that happened to him in electronic journals and posted his story on the internet at www.kpinkerton.com The prosecutor offered to drop the charges if Pinkerton met seven conditions, two of which were that he would take down the website and move off the island. Pinkerton stood his ground. The website grew and after a total of about 40 hearings, all charges were dismissed with prejudice. An appeal filed by the prosecutor was denied.

     PINK FOR MAYOR?

     When the grand jury indicted Pinkerton he was so enraged he went to city hall and filed papers to run for mayor. Technology helped fight these charges, but the two officers are still in uniform and civil litigation is his only available remedy.     Don't Taze Me Bro

    Yesterday Kauai Police Officer Gilbert V. Asuncion stopped his patrol car right in front of our home, directly in front of where I was sitting and jumped out quickly as if he was going to race over and "Taze Me".   

    What actually transpired was nothing more than intimidation, in front of my own home, caught on our CCTV system and the video recorder at the front door.. 

    Officer Gilbert Asuncion likes to stare me down.  He should be more careful not to practice intimidation tactics as the California law firm  I have hired is pursuing a Federal Lawsuit for his role in Civil Rights Violations  against me in the past.  http://www.kpinkerton.com has this information and evidence of his perjury as well as reports of his assault on me.

    The footage is quite detailed and shows me being calmly sitting on a lava rock wall and shows Asuncion practicing intimidation tactics as he has done in the past.  Both police cars have their windows up, rolling past my home, then stopping in front of me,getting out of his patrol car,  starring me down  while talking to the officer in the car behind him.

    All I can say to Kauai Police Officer Gilbert V. Asuncion is; "DONT TAZE ME BRO"

    December 13, 2007 I met with Mike Madigan, author and website operator of The Twisted Badge.  Our time together was well spent and I believe our interview went well.  He is a very fascinating man with many years of private investiagting techniques that have helped him to succeed. 

    The traffic to my site by the IP address below is not from Mike Madigan.  IT is, however, the site useage from a government agent.  I find it interesting that they are looking for gun dealers on Kauai.

    I had met 2 caucasion men at Pizzetta restaurant who spoke of installing systems at the base.  I had asked them if they were G.S. and when they divulged that they were I had told them that Sandia Labs controlls the nukes on West Kauai and then I had expressed to them a dissatisfaction the state our "America" is in.  They said, "so you work for Sandia"  I told them no I dont, I never said that.  I had told them Kauai is a strategically located location for "Star Wars Missile Defense", and that I have had my hand in installing many infrastructures that are currently employed.  When I told them that my technology skills has led me to be arrested 4 times in 11 months, they said" and they still let you on base?"

    I told them I won all my cases and that the local police are not trained in counter terrorism efforts that could potentially be a threat to Americas National Security.

    Later that evening, the men used their internet access carrier, ATT, to google me - Pinkerton Kauai -  this is what I found - tht they had also visited my site in the past and were aware of my efforts.

    Enemy of the State
    Tyrants use laws as instruments of oppression.

    When tyranny is law, revolution is order - 

    The time is getting closer when the Governor of Hawaii and her staff will be dealt with for the treason they have committed against the Constitution and the people of Hawaii.

    Kauai tried to show Maui how to stand firm against tyrants but what happened?  Is there too much big money on Maui that it numbs the minds of politicians and Maui county leaders?

    It will be interesting to see the news that is generated from todays Superferry landing on Maui - wish I was there, maybe I will be  -  with cameras rolling....

    Posted on: Monday, April 14, 2003 FBI help sought in police corruption probe Associated Press LIHU'E, Kaua'i - Kaua'i Mayor Bryan Baptiste says he will ask the U.S. attorney's office and the FBI to investigate allegations of corruption in the Kaua'i Police Department.

    "We have a duty to seek the truth for our citizens, and we take these allegations seriously," Baptiste said in a statement Saturday.

    But the Police Department has "fine men and women" who are dedicated professionals, he said.

    Baptiste acted in response to a federal court lawsuit filed Tuesday by police officer Mark Begley against the county, Police Chief George Freitas, a police lieutenant and a man who is not a police officer.

    Begley said the lieutenant and other officers are members of a criminal organization involved in drug trafficking. He accused Freitas of failing to investigate the situation.

    The lawsuit says the lieutenant is a member of a criminal organization that includes both officers and civilians.!

    Members of the organization seize narcotics from drug dealers but do not make arrests or turn the drugs in as evidence in criminal cases, according to the lawsuit.

    The lawsuit says that in one incident, an officer twice went to Kapa'a High School and was given narcotics taken from students by school administrators, but no police reports ever were filed by the officer and the drugs never were turned in as evidence.

    Begley also said the lieutenant assaulted him, hitting him on the head so hard that he had to be flown to an O'ahu hospital for treatment and that the resulting brain damage has left him disabled.

    The lawsuit also says a woman drug informant complained that drugs she obtained in "controlled buys" were kept by the lieutenant and that arrests were never made.

    It also claims the same woman was raped by a relative of the lieutenant who told her the rape was a warning to keep her mouth shut about the lieutenant's activities.

    Lt. Begley Kauai's new deputy chief of police

    Lt. Mark Begley has been named the new deputy chief of police.

    Chief Darryl Perry announced Begley's selection yesterday.

    Begley was chosen following a written exam, an administrative exercise and an interview on critical issues facing law enforcement, the county and the Kaua'i Police Department.

    The selection committee included Perry, Honolulu Deputy Chief of Police Michael Tucker and Maui Deputy Chief of Police Gary Yabuta.

    Begley will be sworn in Nov. 20.

    Some hidden agenda, some method of obscuring the truth, another cause fro alarm - why have a brain damaged deputy chief?

    Apologies

    It has been brought to my attention that my writings and communications with some individuals have been off balanced and out of character.  I have an explanation to this odd behavior:

    Pain management in the form of prescription medications have been longed prescribed for the injuries I have sustained at the hands of Kauai Law Enforcement which has left my neck and shoulder in excruciating pain.  Once in a great while I do take these medications, not very often though.

    The work I am engaged in as an electrician on a certain jobsite causes me to work with both my arms overhead for about 4 minutes ever 40 minutes, eight times a day for a total of 32 minutes of raised arms over head mode - sending lightning bolts of pain into my skull.  Though I do not want to rot my liver and kidneys from taking these pain meds, I will occasionally take such meds when the pain is too unbearable, other times, the pain is always with me and has never gone away.  The meds do not affect my workmanship and quality of work but do affect my speach and thought patterns, making me appear to be rebelious and "disorderly conduct" - one of the only crimes Kauai Police has never charged me with - 

    Once again to my friends who notice and cared enough to bring this to my attention, I appreciate your honesty.

    Prosecutor Guyot Counseling Officer Gilbert Asuncion

    Inside sources at KPD reported back to me that prosecutor Marc E. Guyot was counseling Kauai police officer Gilbert Asuncion, telling Officer Asuncion not to worry and be calm, that Pinkerton won this round but they will appeal the judges' decision.

    On what grounds?  Newly discovered evidence?  Fabricated evidence? 

    Whatever!  Don't they realize but when and if they do appeal they will be throwing Prosecutor Guyot under the bus as they will have to disclose the reasons they lost?

    Final Judgement: Motion to Reconsider Denied

    This is a hearing on November 6, 2007 in which the Kauai prosecutors tries to pursuade Judge Kathleen N.A. Watanabe to reconsider her ruling back on October 9, 2007 when then, the Honorable Judge Kathleen N.A. Watanabe dismissed the pending charges with prejudice.
